SAPD Intervention on ADA Issues

Recently a member building received a warning notice from the San Antonio Police Department advising them of improper signage at a handicap parking space and requesting compliance within 30 days. We have learned that this action from the SAPD occurs when a citizen files a complaint with them about ADA (Americans with Disabilities) issues. If the issue is not resolved, it can be referred to the appropriate Federal Court to implement legal remedies for the apparent violation, where civil penalties of up to $55,000 for the first offense and $110,000 for subsequent offenses can be assessed. Currently the letter is being sent to the owner of record on the property tax rolls. SABOMA will provide the department with a database of management company contact information for our member buildings so the letter is more likely to end up in the right hands… just another reason it is important to notify the BOMA office when management or ownership changes at member properties!
